How long does a creditor have to wait before selling an account to a collection agency. I got a letter from an attorney in February 2002 for non payment of an account. The last time I paid the account was in November 2001 and I have heard that non-payment would have to of occured for at least 180 days
(6 months).

I think you're confusing the time span which a defaulted account must be chargedoff with collection activity. A creditor can turn your account over to a outside collector anytime they please {assuming you are in default}. They don't have to wait until it is actually charged off.

Also, they may not have sold the account- they may have assigned it to the lawyer.

Its in default when you stop paying. In the miniscule text that is your credit card agreement, they will specify when they consider an account to be in default.
