Trying to avoid small claims court on a credit card debt


What is the name of your state? Maine

I recently returned to work after a 2 year leave. The debt is $820 to Filene's. I have had the card for over 6 yrs.haven't used it in over 4 + yrs. 80% of the debt is late charges and interest (21.60%) On the statement this individual claims that I owe $818.52 + $35.36 interest @ 21.60% from 1/28/05 to 4/11/05? This is confusing?

Yesterday I received a "Statement of Claim" where as the plaintiff requests a judgement against me. Time & date of hearing will come via regular mail.

I wrote a letter (today) to Filene's stating the employment resolve and going forward I plan to pay debt in full and will send a monthly payment of a minimum of $50 per month until pd in full. And enclose a ck.

Should I mail this letter and should I send a copy to atty?

My question is what can I do right now to avoid going to court?

Lastly the atty mentions I could be responsibile for his costs? Is this a threat ?

Call the attorney and make arrangments thru him/her to pay this debt. They MAY accept a settlement, but get ANY agreement in writing first.

No, its not a threat. If it goes to court and attorney's fees are incurred, then YOU are going to have to pay those attorney's fees. They will be tacked onto the amount of the judgment.
