Trying to collect on 13 year old debt - OHIO


What is the name of your state? OHIO

My husband of eight years - got a divorce in 92' from someone else - lived in FLA at the time. They had a lot of debt at the time of divorce. My husband tried to pay on it for awhile and then gave up after getting bogged down with his own bills.

fast forward 13 years - all of the sudden we are getting people calling trying to collect on these debts. We just got one case for $900 to disappear thanks to a lawyer acquaintance that did a freebie for us. He keep harassing them for more info on the debt till they gave up and dropped the case.

NOW we have another VERY rude man (particularly persistent) calling our house everyday hanging up on me when I tell him my husband isn't here (which he rarely is because of his profession) This debt supposedly is for $8500 and they will settle for the bargain price of $4500.

We are scrapping together money this summer for my son with handicaps to go to a day camp - I sure is heck don't have $4000 to pay off my husbands ex-wife putting a YUGO on a credit card 15 years ago,....

When I look up SOL for ohio - it doesn't say anything for open account - does that mean they can sue us forever,..and even if the debt wasn't incurred in Ohio?

The SOL on credit card debt in Ohio is 6 years, however, some companies have managed to argue that these are written contracts because of the signed application, in that case the SOL is 15 years.

What you need to find out is when the date of last activity was on these accounts, that is the date from which the SOL would start tolling, when the last payment was made on them by anyone.
