unauthorized withdraw


What is the name of your state? VA
My wife thats heading for lands unknown withdrew 8,000.00 from a savings account that she was not on. Do I have any chance of getting the bank to replace the $ since she was not on that account?

I cant find much info on bank liability in this kind situation.

I had a previous post on this and some replies that stated that any money I have she may have rights to at least half of it but its like the bank just decided to take matters into there own hands.

I know I can try and recover the money from her in civil court but I wouldnt have this problem if the bank hadnt droped the ball and gave her access to the account?

Can I sue the bank????
What can I do????

Start at the beginning. HOW was she allowed to withdraw the money, if her name wasn't on the account?

You'r kidding about the amount right, I had my now x-wife and her boy friend back 10 years ago take that exact amount the same way.
She wasn't on an account I had saving for the divorce. I didn't get a penny back.

The previous post I had on this is only one page back in the archives. It will explain a llittle more.
The girl at the credit union that gave her access did know her and myself. BUT the only access that my wife had to the account was cashing the support checks I had been giving her monthly for years and she had been cashing them at my bank. The teller is young and I have no idea why she would of let my wife have any access. My wife got 500.00 in the drivethru some how with my ss# I dont think she knew my account #. Then she came inside a couple hours later and withdrew 7500.00 more. I do know when she came inside they told her she wasnt on the account. Then from what I understand someone came up with the idea that they would call me and get approval over the phone. Well the person making the withdraw is the person that gave them the phone # to call and whoever ansewered the phone told the teller to give her the money. I dont have a cell phone and the only number the bank has is an old cell phone number of mine.

I called the bank yesterday and ask them for a copy of the two withdraw tickets and one of the high up bank personel told me they would not provide me the tickets or be talking about this anymore. If I wanted copys of anything to contact there lawer and gave me his name and adress.

I called the National Credit Union Administration yesterday evening and left them a message. They called me back this morning at 7:15 am. The lady ask if my wife was on the account. I said NO. She gave me an office to contact, told me to write a statement, make sure I put in my statement that the bank would not give me info I was asking for and all the other crap they have given me the last 6 weeks.

She acted like if she wasnt on the account and my signiture wasnt on all transactions then it was an open and shut case. She laughed about the bank saying I approved it over the phone.

I hope the NCUA can get something done.

By the way the bank is having there annual shareholders meeting Sunday and the Board of Directors and lots of people will be there. The news letter they sent out said this is your time to come and let the credit union know if they are meeting your needs. I wonder if this might be a good forum to put this out there in front of everyone where they would have to give me some kind of ansewer or if it would hurt my case?
