uncooperative collection agency

What is the name of your state? WA. We are having problems with a collection agency. they are not responding to any of our written requests for a full accounting of all activity, including payment receipts, balances, repayment options. They have been durogatory and rude in their phone conversations with my husband so we are no longer willing to have further communication with them unless it is in writing. We sent them a certified letter stating this fact and requesting a full accounting of the account to include all payments, interest rate and beginning and current balances. All we recceived was a phone call 2 days after receipt of letter, which was declined, and a balance that was 3 months old. We have been making minimal payments in good faith, with requests for verification of payment receipt and account updates included, but have gotten no response. We have sent all documentation that we have received along with durogatory phone discussions and garnishment threats to the state Attorney General's office and the Better Business Bureau buyt all we were told was report them to the FTC. Do we have any other options and what about an escrow account? DO we have any rights?

Assuming that you have done all the required steps in the validation process and the creditors or collectors have still failed to comply, you can take legal action against them.

A good site with information on this is:

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Up until now, we had never heard about the validation process but the first communication we received from this collection company stated it was the second notice. Since we never received the first one how could this be the second? Also, in telephone "discussions" with 3 separate representatives from this company, they were all very rude and unwilling to negotiate repayment options. Each one threatened garnishment if we did not pay in full. and please note, they each gave different percentage amounts with the lowest being 25%. We have never disputed owing the amount just how much we could afford to pay. We tried to open an escrow account but we were told we needed a lawyer to do this. Is that true?

"Since we never received the first one how could this be the second?"
*** Not relevant.

"Also, in telephone "discussions" with 3 separate representatives from this company, they were all very rude and unwilling to negotiate repayment options."
*** Also, not relevant... and expected.

"Each one threatened garnishment if we did not pay in full."
*** If they threatened that, and do NOT have a judgment against you, that would be a violation of the FDCPA.

"and please note, they each gave different percentage amounts with the lowest being 25%."
*** Again, not relevant.

"We have never disputed owing the amount just how much we could afford to pay."
*** Okay.

"We tried to open an escrow account but we were told we needed a lawyer to do this. Is that true?"
*** Depends. What are you trying to open an escrow account to do??
