Unknown Debt

i'm in texas. i was recently contacted by a collection agency claiming i owe a debt that goes as far back as 1993 to 1996. i only dispute this debt because in the course of the past five years i have bought a home and have had several credit reports run. none of them showed this debt. now it's popped up out of the blue and they are harassing me for payment. and have threatened legal action. by the way, they are charging me for the years of interest and late fees for this debt.
what recourse do i have?

Did they give you proof of the debt? Did you ask for proof? Do you agree that you owe the debt?

i am certain that the credit card they are referring to was mine. i closed that account (so i thought) some years ago. no they have not sent me proof or statement of debt. i did receive a letter of debt collection and a threat to take legal action. i intend to dispute the debt. only on the basis that i haven't had any tangible evidence of what the debt is for. i am more than willing at this time to pay my debt. i've been working very hard to correct and amend my credit. this is disturbing to me. but i refuse to be bullied into paying a debt that is so old and not verified.

Heidi....do this, send them a certified letter stating you will deal with only the original creditor. Then don't worry about it. Statute of limitations in Texas has come and gone. In your letter also state that they better not negative report you to any credit bureau and if they have already, they need to get it corrected asap.

En primer lugar es contra la ley para ellos amenezarte con esta tipo de accion si no lo actualmente tienen intenciones de acerlo y los cortes ya han dicho muchas veces que la unica mannera in que pueden amenezar asi es si ya lo han hecho la lio en adelante de amenizar a uno.
Usted si puede quejar de esto in corte si es necessario.

Si Usted pide en carta certificado y registrado ellos tienen que probar que la droga es tuya. Ademas ellos tienen que probarlo en trenta dias.

Sra, aunque soy gringo estoy casado con una Mexicana y por eso entiende y escribir en Espa&#241ol. Ahorita estoy contestando a Ud. en esta forma porque los abogados aqui creen muy poderosos y formidables y obviousamente creen que soy un ignorante que no sabe nadita de lo que estoy hablando pero me trabajo es ayudando la gente con sus problemas de drogas y tengo muchas clientes mexicanos porque entre me esposa y yo conocemos muchas mexicanos y tenemos que hablar afuerzas.
Entonces, en caso que Ud. quiere contestarme haga el favor de hacerlo in esta idioma porque ellos probablemente no entienden y asi no van a seguir con sus mugres platos conmigo.

Ojala que tengas un buen A&#241o Nuevo y lo desfuitas in lo mejor de salud.

(LOL) Y vas a ver. Van a fijar en los traduccions mechanicos pero la chiste es que no salen bien. Los computadoras no tienen la capacidad de hacer traducciones correctos. Sale muy mal. Pero tambien puedo hablar in otros idiomas tambien. Espa&#241ol no es mi unica. Mi primero era Aleman y atravez de los a&#241os he aprendido varios otros tambien. Portugese, italiano y mas. Latino tambien.

No soy perfecto, usted no es perfecto, sino que usted se olvida. ...IAAL es perfecto. Si usted no me cree, apenas pregúntele que, él le dirá.

Éste será mi y solamente poste español dirigidos a usted. Respeto su deseo que se hablará en inglés. Una de las razones principales que él procuraba hablarle en español es porque hay pares de los carteles regulares en este sitio que piensan que él es regalo del dios, que sabe todas las respuestas y viciously que atacará los que demuestren cualquier inteligencia.

Another course of action you can take is to get a copy of your credit report. See if any negative reports are on there.

In regards to the interest rate, it would be whatever you originally agreed upon with the original creditor.

If you haven't read the Fair Debt Collections Act, do a search on the net and you will find many sites that have this Act posted in it's entirity. This is very informative and will tell you of many of the rights you have.
