Update to SOL for Illinois


hi again from illinois.

i sent a crrr letter to my collection company back on 5/16/02. finally received a response yesterday. i asked them to validate the debt by providing a signed agreement/contract etc. i used one of the form letters from previous websites suggested. what i received back was a letter saying i still owe the money, and an affadavit signed and notorized. per previous info given to me, the sol for illinois for signed contracts is 10 years, the debt is now over 14 years old. what do i send them now? a cease and desist order?

thanks in advance for the advice.

What you describe doesn't sound like a valid 'verification' to me; however, with the SOL issue, it is probably moot.

Send them another letter (Certified RRR) telling them that they have failed in providing sufficient 'validation' as requested and in any case, the SOL has 'tolled' on the debt. Demand that they cease and desist any further action or you will consider taking legal action against them for violating the FDCPA.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

thanks for the advice. but do i specifically tell them that the sol has run its course? i would think they are aware of that. maybe they think i'm not?

There are LOTS (LOTS!) of these bottom-feeding, scum-sucking debt collectors out there who prey on those who don't know anything about SOL's or the FDCPA. They simply purchase these old (often expired) debts for less than pennies on the dollar then send out 'pay me' letters.... and guess what?? Some people pay!!

Assert your rights and don't be a victim to them!

I'm sorry, but I've lost the website that was recommended here for the form letter copies. Does anyone out there have it by chance? I would very much like to send a cease and desist letter to my scumbag collection agency.
