Question

Wachovia CC & Checking Account


What is the name of your state (only U.S. law)? Texas

Hello, I have a credit card which is now closed by my request with Wachovia which is now owned by Wells Fargo. I also have a checking, savings and business checking account with Wachovia. I have recently undergone some severe medical problems which has left me not able to afford to pay some of my bills. My question is, if I dont pay this credit card bill, since it is with the same company as my checking and savings accounts, can Wachovia freeze my checking and or savings account or could they garnish or debit my account without my permission or a court order?

Thanks for any help anyone can provide in advance on this question.What is the name of your state (only U.S. law)?

Yes, they do have the "right to offset", which generally means they take as much of your money as they want to pay your delinquent credit card bills. Read your cardholder and account agreements.

I would suggest opening a new bank account at a different institution.

SRG... this one use to always get me. Actually the terminology is right of setoff.
