wage garishment


I live in Texas and just had a "default judgement" against me for an unsecured credit card debt. Can the attorney garnish my wages?

TX does not have a wage garnishment law.

You said Texas does not have a wage garnishment law. A law protecting or unprotecting the consumer?

Can they garnish my wages?

no, if a state has a wage garnishment law it does not protect the consumer except by the exemption clause.

they cant take your paycheck through garnishments but, It wont stop them from taking your checking, savings account though**************.. watch where you put your money, especially if its direct deposit.... and I do beleive they can put leins on your property as well..... either way...

who's name is the debt in? if its in the wifes move your checking account somewhere else without her name. or vice versa... if its both, cash your checks do away with direct deposit if you have it and use money orders... if not your next post will be, "HELP they froze my checking account and took my money to live on"...... (I'm not a lawyer just my opinion and I read lot on here)..... good luck....

We do all that. My attorney friend advised me to keep no more than $1000 in savings/checking accounts. Because it was an unsecured CC debt, I don't think they can put a lein on my home or primary auto.

Any other feedback is always welcome
