What to ask debtor at appearance

Recently won Small Claims judgment, debtor ran bt I foud her. Am srving her with Judgment Debtor Appearance papers. Would like to know what questions to ask her and what to look for to garnish, execute on, etc. Live in Washington Co Oregon Creditor and debtor. This is my frist time doing this type of action, no experience!

My response:

An examination of a judgment debtor or third party is the postjudgment equivalent of a deposition. An examination can be used to identify property in the possession or control of the judgment debtor or a third person (e.g., a nondebtor spouse), to learn about property the debtor may obtain in the future, and to require the debtor or third person to turn over property to the levying officer.

At the conclusion of the exam, the creditor may obtain a "turnover order" requiring the debtor or third person to deliver the identified assets to the levying officer or, in some cases, the creditor or a receiver. Such orders are enforceable by contempt, and may be far more effective than levying on property under writ of execution.Moreover, as soon as the examination order is served, the debtor knows that the creditor is actively seeking collection. As a result, the debtor might attempt to dissipate, transfer or conceal assets, or may file bankruptcy. The debtor's personal property will generally be subject to the one-year lien, but the lien might be lost by the debtor's sale to a bona fide purchaser

However, an examinee may not be required to attend an examination before a court that is:
• Located outside the county in which the person resides or has a place of business; and
• More than 150 miles from the examinee's residence or business.

When the above limitations are exceeded, the examination may be held in a court of similar or higher jurisdiction in the county where the examinee resides or has a place of business.
