what are my rights?


What is the name of your state? ohio

I opened up a citibank card in 1999 I was 19 yrs old the last payment that I made was in 2001. I moved a few times and always forwarded my address but I never recieved any bills and I forgot about it. I just recieved a phone call and they want something like 2000 dollars by tonight or else it is going to be taken to court. I know I owe the money. I don't have that kind of money and have no means of borrowing it. I am married now I do not work I stay at home with our children I have one vehicle in my name and a joint checking account with my husband. Can his wages be garnished? What advice do you have for me?

Scare tactic.. pure and simple. Typical collection agency ploy - create a sense of urgency and scare you to get their hands into your wallet. Ignore the bogus "deadline" drivel.

Absolutely not, its not HIS debt, it's yours. Besides, no one can garnish ANYTHING without actually suing you first and winning a judgment. If it goes that far, then the joint bank account would be easy pickings and it would be drained dry.

FYI, the statute of limitations in OH is FIFTEEN YEARS, so be prepared to be harrassed for a VERY long time - if you aren't sued at some point.

If you don't want to put up with the harrassement, find some way to pay the bill, otherwise it's just going to keep piling up interest and will be a real monster in a few more years.
