Well, you can sue anyone for anything.

The challenge is to prove that you were financially harmed. How you gonna do that?

Contact a debtor rights attorney and have a conversation. Wachovia has deep pockets and will not look good if indeed their employee did what you said.

Wachovia fraud


The incident has been reported to the credit bureaus and my credit will take a hit since there is a late charge to the account. The financial harmed would be the 2 open accounts and late charges will lower my credit score. I'm in the mortage business and I use my credit to buy real estate investments. The financial harm could be a lot it depends how you look at it. The higher the credit score, the more I can borrowed.

I have talked to their fraud management VP of the bank and they gave me a letter pretty much implementing them and that they messed up. I was surprise they wrote that letter. I had to signed the letter so they can get the process going to close the account. The forged signatures were not mine.

The fraud department were aware of this for about a month but they didn't freeze my account or stop the VP from keep doing this. I guess they want to see where this is going to go. I don't know what they were trying to do by letting this VP keep his job and let him do this.

Do you think I have a case against them? From just talking to a few Legal people, they think the bank might want to settle out of court.

You do know that they can correct your credit record, right? I would imagine that would be part of their process of clearing the mess up.

I have been trying to contact the Fraud guy but no luck getting a hold of him to see if they clean up the mess or not. I do not know if they sent the credit bureaus anything to state that it was a mistake.

The VP was fired after my incident but it took them 2-3 weeks before he was let go. During the 2-3 weeks, he was still employed by the bank.
