What next?


What is the name of your state? IL

So Many Questions …

Discover charge off on my CR. Equifax will not remove, I sent letter CRRR NOT MINE their response - they have verified that this item has been reported correctly. Item is listed as joint account, I don’t remember the details, the account was opened so many years ago, we were married 27 yrs. But this debt was ALL charged by him after our divorce he admits. I have a signed letter from him to this effect, not sure if this would be any help. He had lots of credit cards, loved them but I canceled most of them at divorce. I didn’t have any information / paperwork on this one.. I am obviously concerned about the joint acct issue, I cannot afford to pay this, over 10K, and would not want to anyway since it is not mine.

I want to send a validate letter, but should I send it to Discover or Equifax.

The item says paid and closed under activity description AND Account transferred or sold under current status so does this mean it was sold to a CA.

If it was sold to a CA, why don’t they have a TL on my CR? Or why aren’t they hounding the **** out of me? Not that I’m complaining just baffled.

Why haven’t I been sued? I mean I know why he hasn’t, he has no assets, but I do.

TransUnion removed this item from my CR a year ago after I sent NOT MINE letter to them. Is it possible it is back on my TU CR? I thought if it reappeared they had to tell me.

Why would one CR remove it and not another?

If they do validate - it is possible it’s a joint account – am I responsible for his debt?

I guess I’m just confused and concerned and not quite sure what to do next.

Neither. Original creditors do no have to validate and Equifax is not a creditor. You would have to send the validation demand letter to the collection agency who has the debt.

Yep, that's what it means !

There are no requirements that a CA has to report to the credit bureaus, or any creditor for that matter. Why they're not hounding you is anybody's guess.

It is possible, have you looked ? If the item was removed BY TU, then, yes, they must notify you, in writing, within 5 days of the reinsertion.

The 3 CRA's don't collaborate. They are separate businessess and they each do things their own ways according to their own policies and practices.

If it IS a joint account, meaning you SIGNED the application, then YES, you would be responsible for the debt too.

What you need to do next is send the validation letter to the right collection agency handling the debt.
