who can sue?

What is the name of your state? Kentucky Can a collection agency sue for judgement or does it have to be the original creditor?

Most collection agencies work as agents of the original creditor (for a percentage of recovery). If that is the case in your situation, then the original creditor would have to file the lawsuit.

However, in some cases (especially aged debt), the debt collector may have purchased the debt outright (making them the creditor). In that case, the agent/creditor can file the lawsuit.

This is one of the reasons that it is important to get a 'validation' of the debt..... to see who actually owns it and under what authority.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Also the collection agency may have a legal department that will file for judgement for the original creditor for an extra fee and a power of attorney to act on its behalf on that account.
