One month after the death of her husband (January of 2001), my mother-in-law was persuaded by the financial manager at her bank to move the 401K from another company to that bank. He told her he would double her money. Instead, he lost $40,000, a substantial portion of her 401K. She was clearly not capable of making rational decisions at the time, and the financial manager pressured her and misrepresented what he could accomplish. Does she have any recourse in legal action?
