Amazon marketplace cancels contract, now refuse to pay $10k

What is the name of your state? California

We've been selling in Amazon for almost a year now (since Sept of '06). We're not a BIG seller but we do give a few thousand dollars to Amazon every month for the revenue they have generated for us.

Recently we were blocked. They falsely accused us of selling counterfeit items and now we're blocked and it's permanent.

I have a feeling I know which items Amazon is talking about. But those items are authentic. After discussing with my supplier, I have submitted two documents to Amazon. 1. the legal trademark document and 2. our invoice from the authorized distributor.

I have sent the email below in order to contact with Amazon, they reply and said the decision is final and it will not be reversed.

Now they have withheld our earnings of the last two weeks (which is $9508.35). What should I do?

Sincerely,
Peter

Below is the email sent to alliance@amazon.com

Dear Alliance,

We want to let you know that we are fully compliant and are not selling counterfeits.

To ensure our Valentino product's and authenticity, I have enclosed to documents:

1) The trademark of the product provided by the owner of the trademark

2) The invoice that AccessoryBug has purchased via an authorized
distributor (MDG International Inc. - also documented on the trademark document.)

Please lift the block in our store because we have always followed Amazon rules and policies.

Please verify the authenticity of these documents. These are authentic legal documents. Please don't accuse us of selling counterfeits. We definitely are not. We're currently selling these products at below our cost right now. Most sellers/customers have mistaken the low prices for counterfeits. This is obviously not true. We have the legal documents and we purchase via authorized distributors. Please do not mistaken a promotion for us selling fake goods.

Sincerely,
Peter Lin

Well, do the terms of your contract allow them to block you and withhold earned commissions? What does the contract say when you don't agree with their decision? What are the steps you are to follow? Since none of us can see your contract, we can't speculate.
