What is the name of your state (only U.S. law)? Maine

My company is a website hosting company. We have a client who regularly makes late payments, and in fact, they carry an outstanding balance. May my company apply the client payments to any invoice we want? What if the memo field on the client payment check specifies an invoice (for example "For Invoice #1063")? For the record, we've been applying payments to the oldest invoice.

To apply it differently than requested by the client, you would need a stated policy that is agreed to by the person in some way.
