I am operating a franchise for a absentee owner who told me to open my own business account and obtain a business license. I have not signed a franchise agreement.

The franchise contract with the absentee owner is still in force and has 4 years to go.

I operate the business as a DBA. Tara DBA Great Clips of Utah. I continue to pay the franchise fees for the absentee owner, and run the business according to the franchise rules. The Franchise is aware that I am 'managing' the salon.

Can the Franchise sue me for using their business name 'Great Clips' without a franchise agreement in place, between myself and them?
