We lease a space inside of a commercial building where the landlord subleases private studio space to hair sylists and other beautiful profession.

My question is whether that landlord has the legal right to refuse the renewal of a lease to a tenant of the studio without sufficient cause?

For example, if we had been renting for nearly 3yrs with no late rent payments or issues of any kind but were told they would not renew our lease only to then lease to someone else who would be using the same space for the same purpose...would that be legal or could the landlord be liable for damages of any kind?

You need to review your lease for details, but in general yes, with proper notice according to the terms of the lease and the law, the landlord would have the right to not renew.

What?!

You are a commercial proprietor of some sort and have to ask whether as lessee you would be entitled to damages if the lessor refuses to renew your lease? What if he refused to grant the lease in the first place?

And how about you being liable to the lessor in damages should you opt not to renew? Would that not smack of economical servitude; being an indentured tenant/landlord?

And as far as the language in the lease is concerned the only wording that would extricate you from the dilemma would be those spelling out your option to renew.
