Do I have to pay this independent contractor who didn't perform duties?

My company, (C- corporation) contracted this guy in New Jersey to do telemarketing work for us. He was supposed to send us a certain amount of email addresses from people he called for us and sell our service to. He didn't send nearly the amount as in the quota in the contract, and the ones he did send were bad emails and people who didn't even know him.

Now, he wants us to pay him for this crappy work. On his resume he said that he was a professional telemarketer and he signed a contract that he could do the job, but he didn't. Now he is threatening to sue us, report us to the BBB, etc, etc if we don't pay him. We have records that he did not perform the work.
