I have a customer I am doing an export for to Canada. The export is leaving Sept 15/08, and there is a remaining balance we have agreed to have him (the customer) pay to me (the seller) in 2 installments. I would like to put a late fee, or surcharge into the contract that is legal, and can hold up in court.
My question is: How much can I legally charge as a late fee if the payment is late, or in the case of non-payment, without the contract being voided in a court of law?
Also, what are the legalities of such a contract between me (U.S. resident), and my customer (Canadian resident)?
