Payment checked return as NSF, agreement still valid?

What is the name of your state? NY

We agreed (by email only) to develop a website for a company, who agreed to pay on bi-weekly basis. Last month, the check they sent us was returned as NSF. We informed them and they deposit another check, which returned as NSF again.

Question: because they have not submit any payment, do we still have any obligation towards the web site project? They said if we remove the files they will sue us for any damage caused. :confused:
