using my photo and name

do i have a case here
and what errer if any have they made.
i own a block of appartment and have a contract this year with a holiday company that sends customers to us. we have been using the same holiday company for many yearsand have lots of regular customers.

next year 2010 we have decided to not use the same company. but looking at thier brosure they have our appartments in there but with twice as many room we have had email of our reqular customer ask how come we are using that companmy again and we said we are not.

it is obvious that the company is using our company name and pictures to steal our regular customers and then send then to a different place last minuite

thank you for your help
