3 Unit water front condo building built over lot line on up lands. What is the name of your state? Michigan, Clay Twp 48001
I need to understand legal liabilities or what may occur if I buy a condo building that is built over an old lot line that is indicated on the condo complex survey? There are not any known complaints by any township, city, state of federal agency, other condo owners or the association members.
The building actually contains three attached efficiency units, it is only this first unit that goes over the old surveyed lot line, the second unit touches it, the third unit is within the lot line. The property butts up to the St Clair River which is an international waterway. I am speculating that the condo property was extended beyond the lot boundary when a sea wall was installed and earth was backfilled up to the wall (no one has been able to provide any federal or state approvals), then the building was built, which extends beyond the original lot idicated at time of survey. This area is know for cycles of high and low water, low water eras make it easy to usually get approval for sea wall installation and back fill or reclaimation, I think this is now considered up lands? This condo complex was a family cottage rental venture prior to 1991, it was then converted to condos by the original owner and sold as such, documents and condo creation seem to be in order. The building in question is actually owned by the family of the original developer. They are trying to sell these three units at this time.
