I sold a duplex that we owned to a party as a cash sale. The Offer to Purchase was sent to me and in the area of the form Line 180-Additional provisions/Contingencies I (the seller) added the following statement: "current tenants shall receive a minimum 6-month notice to vacate from closing date (10/29/2004), current rent amount to be in effect for same time frame".
I signed the Offer to Purchase and we closed on Oct. 29, 2004. Now the owner has sent eviction notices to both tenants and gave them until feb. 28, 2005 to vacate the property.
Would this action be seen as a breach of the contract (offer to Purchase)? and allow me to seek compensation for the tenants who will have to move out in a time frame they were not planning on. They had plans to leave by April 28, 2005 (per the addendum to the offer to purchase)??? |
