Am I bound to this realtor


What is the name of your state? Florida

I was looking at houses with a realtor and found several that interested me. I was split between making an offer on a foreclosure house and a short sale house. Last Saturday I decided to drive by these houses again on my own time without the realtor and saw a For Sale By Owner house. I decided to check it out and called the owner. After walking through the house I knew that this was a good house for me. On Sunday I came back, still without the realtor, to take a closer look at the house and decided I wanted to make an offer.

Since I am a first time home buyer the whole process is a little intimidating to me. I asked a few people I knew how to handle it and most thought I should try to go through my realtor. I talked to him and at first I thought I would be able to pay him a fee basis for the paperwork. As we were writing up the offer he would not change his commission amount. He refused to take anything less than 3% commission. By this point I wanted to go through with the offer and see if the owners would accept. I also had to sign a Transaction Broker Notice which states that he will act more as a mediator for this sale and not be working on my behalf. I also signed the FAR "As Is" Contract for Sale and Purchase.

After making the offer, I knew it was a mistake. The owners were upset at how the realtor handled it and do not want to pay the realtor commissions. On Wednesday I made an offer on the foreclosure but the bank rejected it and accepted a different offer that was made. Now I am stuck and really want to make another offer on the FSBO house but the owners will not deal with that realtor.

If I make an offer directly to the owners, will the realtor be able to sue me or come after me at all? Am I at all bound to this realtor? I only signed the "As Is" Contract for Sale and Purchase forms, the Transaction Broker Notice, and the Homeowner's disclosure.

It depends upon the exact agreement with the agent, but almost assuredly.

What agreement with the agent? I never signed an agreement with him. I only signed the offer to purchase the house and the transaction broker notice. I do not see anywhere in there that is binding me to this realtor for anything other than that one specific offer, which is now void and no longer valid.

A SELLER pays the brokers commission not the buyer.
