Can I get out of this contract???What is the name of your state? new york i have a signed contract to purchase a co-op. i have a dog and i was repeatedly told by the sellers and the real estate agent, that even though the building did not allow dogs, that it would be no problem and that all i had to do was "hide" the dog for 30 days. however, after i signed the contract i was informed that i had to sign a statement that i would not bring a dog into the building to live. now, there are some dogs in the building, but they were grandfathered in. i can not in good faith sign this statement, as it is not true, and i fear the repercussions of bringing the dog to live in the building, secretly. i need to back out of this contract, as there is no way i would move somewhere without my dog. i also need to know if i would get back my deposit of $5000. i would so appreciate someone to advise! thanks Last edited by luvmydog; 04-01-2003 at 03:55 PM. |

An attorney would need to review your contract to see if you have an out. |

| I would agree with HomeGuru, and have an attorney review the contract. Then I would simply let the Agent know that based on the incorrect information that was given to you during the negotiation of the contract, you want to cancel, and expect a full return of your deposit. If this agent even gives any indication that the return of the deposit may be in jeopardy, then sick your attorney on them immediately. Do you have anything in writing that the agent gave you this "hide the dog for 30 days" advice? What would the agent say if you asked for it in writing? |

| HomeGuru and BrokerRE-thanx for your input...now, the real estate agent is trying to pressure me. he keeps calling me but i did not accept his call until today. he wanted to know if he got a letter stating that the dog could live there-would i change my mind? then he said he would do everything he could to convince the co-op to let the dog in. but, i feel he should have been upfront about the dog rule and not try to pull strings at the last minute because he doesn't want to lose the deal. besides i don't want to live someplace where my dog is not welcome! I don't want to be in a who might accept the dog under not so friendly conditions. also, if he's willing to do all this now, that means he really did know that there would be aproblem with the dog from the very beginning. he also said to me when i questioned him about the policy a couple of weeks ago-that i told him that it would be ok if the dog did not come. under no circumstances would i ever, ever say anything even remotely like that...he's like oh i thought you did. anyway, i don't want this co-op anymore...if this agent gets a letter about the dog on his own, does this affect my hopes in getting out of the contract? and most if not all my deposit back?
