Basement flooding What is the name of your state (only U.S. law)? Indiana
Recently I purchased a bi-level home in Clarksville, Indiana on June 2, 2009. Since then, our basement has been flooded on four separate counts. The first time was due to water back-up from roots which clogged our main line to the sewer, and thus an insurance claim had to be made. The second time was during a rainstorm, where the drain outside our basement had been covered with leaves and water was entering the basement from the back door. I quickly went outside and removed anything covering the drain and scooped out all excess water from the landing with a 5-gallon bucket. The next time it rained heavily, there was nothing covering the drain, but water was entering from underneath the back door beside the drain yet again. I called a plumber for the 2nd time and they had to snake the drain clean of "whirly-tails" and "mud" (according to the plumber). We sprayed a hose into the drain and verified it was clear. The 3rd time it rained, the drain cover was blocked up with leaves yet again, and the basement proceeded to flood for a 4th time. I purchased a home inspection for $275 prior to buying the house, but he did not run the water long enough for us to notice that roots were clogging the main line to the sewer. The seller never notified me of any water problems in this house before I purchased it. Could any legal action be taken here against either the home inspector or the seller? I've had to since remove all of the carpet and currently am replacing it with tile, and am also looking for some sort of resolution to the problems being encountered by the back drain. Any advice would be appreciated. Thanks. |
