A couple made an offer on our home in May, to close on or before July 31st with no contingencies written in the offer. Our offer on a home was accepted. We needed to close on that property by the first of July because it was an estate sale. During further discussions with realtors our buyers didn't have a buyer yet and therefore were unable to close so we lost our $1000 earnest money and waited to close at the end of the month. Their buyer fell through w/financing issues and we never closed. Extended the contract until August 5 and never closed. Our "buyers" made a contingent offer on another house that's pending and we're back to square one? Are they in breach of our contract? Are they by law obligated to buy our house? Are we entiltled to our lost earnest money? What is our next step? |
**A: yes, they were in breach as of Aug 5 so you have a right to terminate the contract. Where the heck are your and their Realtors?
