Breach of Contract & Ernest Money


What is the name of your state? NC

note: my buyer agent, the sellers agent and my lender are all affiliated... with that said, "here we go" !!!

I entrered a contract to purchase on July 29 and was notified thru my "buyer agent", "six days before the closing" the seller had various liens against the title and that the sellers creditors agreed to satisfy the liens for $2500, to be presented at the closing "UH-OH" !!

Upon guarantee from my agent that the seller had come thru with all conditions, i learned upon my arrival to NC from NY that the seller lied, as well my agent ...

Needless to say after my trek down to NC from NY, not only had i discovered they lied 16 hours before my scheduled closing but i also made the gruesome discovery, the home had been trashed the night before !!! -BUT WAIT, IT GETS BETTER ...

now the sellers angry the closing and sale is off, due to her breach of the contract... my question???

According to NC Law, as i was told by my "buyers agent", the only way I may be allowed to make offers on potential properties is to have all parties : myself and wife, the seller and her ex-husband, to sign an agreement terminating the sale and releaseing all ernest monies back to me, WHICH THE SELLER(WIFE) REFUSES TO SIGN !!! stating she can care less at the moment, even if shes foreclosed upon, "big deal get in line" !!!

What can I do , please note: im in a hotel accruing charges daily down here, as this whole fiasco drags out...

Writer, hire an attorney to help you since your agent is an idiot.
