Question

Broke Contract : demanding comission


What is the name of your state? FL

Ok I broke my contract because A. Found a much better home and deal B. My Realtor was misreprenting me and totally taking advantage of my inexperience.

My attorney sent both realtors a letter informing them of my intention to back out and the fact the realtor had not conducted himself in an ethical manner as my representative. I get a letter from both Companies informing me that they are keeping my deposit and will go after me for their commision.

Ok I expected to loose deposit $5,000 (trust me the other house was worth it, plus it was cheaper so a didn't really loose I got the other house much cheaper then market value). We were suppose to close today, they were informed on Monday about my decision. I checked and the house has already been relisted. they will probably find a quick buyer because homes are selling fast down here.

Question: Does her realtor have the right to demand his commission if he is already selling the property and will get paid comission once the home is sold? Can he collect twice?

My realtor is a dead beat so I expect him to demand his eventhough he didn't do much. I found the house for god sake, not him! I know my fault and I will probably have to pay him.
