Broker Fraud or Negligence ???


Florida - Boca Raton. My mortage broker changed rates on me just three days before our already 2 week late closing, claiming my "rate lock" had expired. His brokerage and chosen lender are the ones who chose to delay the closing citing "incomplete property information", only to rescind this claim and ultimately close 2 weeks late. Had they not delayed the closing, I would have enjoyed the lower interest rate. This is costing me $100k+ over the course of the loan period!

Additionally, after closing I found that my broker had never actually locked in the lower rate, and that as of our original closing date, a rate had not been locked in...not sure whether intentionally or not at this point. I suspect this is the true reason that closing was delayed the two additional weeks.

Is there any legal recourse/precendent here? Woth pursuing? The few local attorneys I've spoken to don't seem interested in helping....too many $1M+ cases going on here in Boca these days, I suppose.

**A: file a complaint with BBB and the State Consumer Protection Office.
