broker requirement to visit home when away?


What is the name of your state?
NC

We contracted with Broker to sell home. Before we signed the agreement we were assurred that broker would look after house while we were living elsewhere. Wife called regularly to make sure that broker or someone was looking in on house. It was always a please check in on it periodically. Valve broke on refrigerator and house was damaged. Another real estate discovered it. Insurance won't cover it, water in their estimation
a couple of weeks. I personally visited it 3 weeks before incident and everything was ok. I know that broker hadn't check in on it for like at least a month and a half. Asked broker why didn't you look out after my house. Quote "my job is to sell it!, I don't have to look out after your house"?

Question are they required to at least check on homes they sell knowing the owner is away.
Why would they mislead us in to thinking they were.

This situation is filed with chamber of commerce and we are starting to take it up with real estate commission in NC.

If they had checked out the house at least once every 3 weeks we would have been covered by insurance.

So? That's an issue between yourself and your insurance carrier. And unless you stipulated in the listing agreement with the broker that they were to accept responsibility for 'looking after the house' then you are out of luck.

Probably so, but it was an oral agreement and reinforced by broker himself that he would at least do the bare minimum and check it out . Called on a monthly basis that it was being checked out and was mislead. Anyhow nc real estate commission is interested in this case..

Contract for listing with them was the understanding or verbal agreement "that we will care and look out after your house while you are gone. They said You have nothing to worry about we will care after your house, notify of any problems, and visit it on a regular basis". This was reinforced month after month into the 7th month when the problem occurred. Found out no one had been to the house in two months. There was a sign in log in house for each visit. Otherwords we took them by their word and their word was a lie. They should of contacted us if they were not going to meet their agreement where we could of found someone else that would. NC Commission is processing our complaint. My guess is that they will continue to lie even when they are sworn in with the commission. They had other people who could of visited the house on a regular basis. This husband and wife broker team
had a house nearby where it would have taken them 7 minutes to check it out travel time and the whole works. It is true that when agreement is made it should be made in writing and it is much more difficult if not impossible to enforce an oral contract.
We called at least once or twice a month to see if they were checking in on house and we got a yes and everything is fine. I would love to mention the name of these people and their real estate but my wife wants me to hold off. Its a small resort community so the word is already out. I personnally worked for a real estate firm in va years ago where we checked homes out on a weekly basis for all the rentals and homes for sale where people were out of town. They should of been up front from the
beginning and not misleading and that is what the commission is interested in.
