Brother did not secure 2nd mort. for dn pymt..!

What is the name of your state?Arizona In 02' I sold my residence of 22 yrs. to my brother for $376K... His 1st mort. pd. $300K and he was supposed to get a 2nd for $76K. He never did and I have been making all of the pymts to his current mort. co. and he has a "Deed of Trust" in his name without ever paying me the $76K He now says he is going to sell it and wants me to move... should I file a lien... suit or ???
