Builder Error

We're having a house built in Maryland, and when the brick was put up we noticed that the windows were not where they are supposed to be. They are pushed to the outside of the house so that there is no room for normal shutters (which WERE specified in the contract). The builder has said that they will supply us with custom shutters (5 inches smaller than we were supposed to get). We don't think this will look good. Also, all the windows are off center in all of the rooms (Ex: Dining room light not centered w/window, etc.) We have asked that the builder move the windows but they said no. We want some allowance from the builder; however, they say no. Do we have a legal leg to stand on?

Where is the project architect in all of this?

You have some problems that must be dealt with now without delay. Hire an attorney if you need to.

The builder is a small company that claims to be really busy. Do you suggest hiring an attorney over attempting to settle the claim through the Better Business Bureau?

The bbb does not settle claims as they are not attorneys and have no governmental authority as regulators.
In most cases against builders, the bbb was useless because if bbb sends a letter to the builder, the builder is not obligated to respond or responds with a smoke and mirror spin doctor answer.
Ask the many homebuyers how the bbb has helped.
