builder sueing me am i screwed ?


What is the name of your state? n.j i had to break a new home contract with the builder /real estate agency i had no sale of my house contingency in the contract only a contingency of being able to get a morgatge well my house sale fell thru 2 weeks before close .builder says he is suing me for $15000 my lender told them in writing i cannot get a morgatage of $700000 only had a $250000 mortage commitment. i just found out they closed today on the new house with someone else .i was under contract to buy the house for $479000 they relisted it for $500000 i belive it sold for alot more then i was under contract for 10 to 20 thousand more .can he still sue me for $15000 even though he sold it for 10 to 20 thousand more then i was under contract for ? im out about $2500 so for in this house and he wont settle he says it dont matter how much more he sold it for he wants $ 15000 . the house closed 1 and a half months after my contract was due .can i win if this goes to trial ? i'll fight it all the way he's a greedy little prick he already kept thousands from the first people who were supposed to buy the house .there sale fell thru too..sorry its so long just wanted to give as much info as possable ...thanks{yes i have a lawyer and a real estate agent i have not had any help with them thats why i'm here ]thanks ...

If all that you say is 100% true, I cannot see where the greedy little prick has a case.

i'll find out in a day or two just how much it sold for per my lawyerif it sold like i think it did ..do i have case against him for the $1000 deposit and $1500 in appliances [personal property] new micro . dishwaser. ceiling fans i brought and they installed after i told them the deal is off to stop and return it ?thanks again

You should discuss these fine points with your lawyer.

does any one know how to find out the final sale price on this house ...mls#1669978 ..221 point breeze drive hewitt n.j 07421 they refuse to answer me when my lawyer and i questioned them on it.it closed yesterday .i even called the tax office where it was sold they said it could take months for them to get the sale price..the greedy little prick even took pictures of my kitchen appiances and put them on the mls after i told him not to install them....i even called the builder / real estate office that sold the house they are all playing stupid no one knows or will answer how much it sold for from the sec.to the guys that built and sold it .they are up to no good trying to hide info ...if anyone knows or can find out how much it sold for i can really use some help ..my realestate agent and lawyer keep saying they will find out i just dont like putting my ass on the line with someone else waiting to see what to do with it . thanks again**************..

New Jersey!


I was all over the state of New Jersey's website, including the county Tax assessor. From what I gathered, the property is in Passaic County. They don't seem to have an online system (at least not one **I** could find) for property taxes. The county website said that documents can be viewed in person (I think they are a little backward)). I don't know if this will help you or not, but you might try someone in the link I've attached to find out if you can file a complaint. It is with the state's real estate license department.

thanks ...i plan on filling complaints against the real estate agency keller williams and in piticular the owner mark werner and the builder scott since the both claim to be the owners of the home in question ..the home is in passic county n.j **************.i really need to find out how much it sold for so i can show how they screwed me and the 1st people who also lost $ on it **************....thanks for trying**************..home gru......senior judge..where are you?could use your help**************...

house sold for $16000 more


just got served with law suit papers today being sued for breach of contract ..the house was back in contract [new person]3 weeks after my close date .it closed 1 month three weeks after my close date .for $16000 more than my contract price .how can this prick sue us for damages [he claimed from taking it off the market .and extra money he put in the house by taking down a very dangerous tree it had a crack in it 15 feet long leaning towards neighbors house we had nothing in writing to remove it just asked to have it looked at we have pictures it looked dangerous.also a set of wood stairs he built after we told him in writing the deal is off to stop any work he might do and return our money and proptery.the stairs were the co owner and realestate agent idea to do we never requested the stairs it was sugested because it was in the origanal blue prints but never built now my laywer is counter suing for my deposit money and personal proptery .is this normal ?does he have a chance to win against me..?need advise what to do and what to expect..thanks

i was at my lawyers 30 min after i got served he acted like it was no big deal he said he will take care of it all ....i cant tell if he is briliant [ so laid back like its nothing ]or if he dont know what he is doing..thats why im looking for more advice from others to compare to...any ideas? forgot to say he is suing me for $15000 plus $1500 att. fees greedy s.o.b.

You do not want a lawyer who is as upset as you are about the deal. On the other hand, lawyers should explain things to your satisfaction. If you do not understand what the lawyer is doing, you need to ask him to explain it to you.
