A buyer backing out


What is the name of your state? CO
We had a sales contract signed by a buyer to purchase our home with a 60 day closing. No contingencies for the sale of her current home or financial contingencies. A week before closing we recieved an email from the buyers agent stating that she wanted to terminate the transaction because the buyer received the covenants laws for our subdivision 1 day late. The documents were provided to the buyer 4 weeks prior to their email indicating their objections. The buyer did not show up for the closing (we did and we signed all the papers) They buyer has requested to get their earnest money. We have asked to go to mediation as our contract requires. They refused. Do we have a chance to recover the earnest money in a small claims court? The buyers are located in California. If we sue them do we have to file in California and then go there for the trial? This will be for the amount of $7,500. HELP
