Buyer is giving me a run around


What is the name of your state? Kansas
I am selling my home in Ks. I used a atty. to draw up the papers , the buyer lives in another state ..but she has ties to the area, and wanted to move back to this area as her brother bulit the house ..well, I used a atty. to draw up the contract the 1st time with this gal ..she couldnt come up with the money ..( this is a rural area also ) so she called me back and said ..look if you carry the loan again ..Ill give you 4000. more (she lost the first 1000. cause she didnt do the contract with me so all together she has put 5000. down on it ..well now its 10 days to close my atty called me and said she called him and wants me to do another contract with her saying the house was being sold for more money so she could get a better loan ( I think ?) for lower intrest ..I said and my atty. said ..this is fraud !! I said no way ..get my money or the quit clain will go in force in 11 days. She has took the carpets out of the house ..and the cuborads, and the stove ...gonna redue it ....if she does not go thru with the contract what can I do ...? Can I make her put the stuff back in thru the atty. ? I have already paid my atty. for the contracts etc. he is paid off ..WHAT THE HECK CAN I DO ..?

**A: what the heck, have the attorney foreclose on the property asap.

I have a quit claim signed buy her for Oct.1 to go into effect..so why start forcloser or should I ..wont the quit claim be enough ..she has already done the damage..can she say she put 5000. down on the home and that should cover what she has done ? I know now I should of never of done this ..

**A: if you signed a deed already without getting the entire purchase price then your attorney that helped you is a real idiot.
Hire another attorney.

My atty. has the deed and the quit claim in his safe ..it reverts back to me if she doesnt complete the deal by Oct. 1st ..So I will get the deed and quit claim back now im scared is he the idiot or me ..? I had this atty. handel other things for me and I didnt have any problems with other matters , and he was always paid in full for all he did so he would have no reason to screw me over ...did he by having me sign that "contract to purchase and sale of said real estate?"

**A: well, why did you not provide that important piece of info at the start?
If the deed to the Buyer was not recorded and your attorney is holding it, then title is still in your name. And you can foreclose.
