Buyer trying to back out !!!

i have contract with buyer through a real estate co designed to help fisbo's. buyer has financing in place and a settlement scheduled for 12/5. buyer has notified me he is no longer comfortable with deal and wants out.

can i relist and sell the property with out his release?

what damages can i attempt to recover from buyer? i passed on 2 back up contacts while he was under contract and specifically asked him for a release (which he declinced to release me)

do i have to wait for settlement date to pass b4 i take legal action?
