Buyer wants to sue me


What is the name of your state? Texas
I just relocated from Washington State where I sold my home. Buyer has been in the home for 1 month. Home is 3 1/2 years old. We had a patio room built onto the house. Buyer hired an inspector, & after fixing some minor things (touch up paint, etc) we closed transaction in January 2003. Adding that he was the most nit-picky person and very difficult to satisfy. Now we are hearing that he is going to see an attorney to sue us because the patio room is "separating from the house" and when he puts a load of dishes in the dishwasher, the sink backs up. I have no idea what he is talking about re: the patio room. I would think that this kind of thing would have been caught by the inspector. We saw and knew of no problems regarding the patio room. As for the dishwasher, I would think he probably needs to run the garbage disposal to clear the drain. Any homeowner would know this. He is saying he is going to sue us for fraud because we didn't disclose the problems with the house. As far as we're concerned, there was nothing to disclose. Please advise

**A: the State of Washington laws apply. Do you have a copy of the inspection report? If so, what does it say about the patio cracks, kitchen sink and dishwasher drain?

Nothing was mentioned about the patio or drain or dishwasher. The house was well kept. As a matter of fact the inspector was at the house twice and the buyer was at the house on numerous times. She had many chances to back out of the deal.

I want to add that the buyer did sign before closing an addendum agreeing to purchase the house as is. He wanted me to have the carpets professionally cleaned 2 days before closing and to climb on the roof to remove branches. I refused then he came back on the addendum with agreeing to buy house as is. Now, he wants to sue me. Do you think this can still happen even with that signed document??

Yes, he can sue but the question is, will he prevail.
Did you sell the home using a real esate agent? If so, ask the agent to help you respond to the Buyer.

I did use an agent but she did not make any commission off the sale. I haven't yet heard from the buyer. All I know is he contacted my agent's broker & the broker told my agent to inform me that the buyer states he is seeing an atty. I'll see what happens. I don't think he has a leg to stand on. Thanks for all the advice.
