Buyers filing lawsuitWhat is the name of your state? OH We just sold our home last month and now the buyers are filing a lawsuit against us and I think the realty company as well. I am so utterly ticked off that I can't even see straight. Without going into too many details (just in case these yo-yo's happen to see this), basically they are claiming we took things that were in the purchase agreement to stay, which is true by the way, however, the buyers gave us permission to take them, I have proof of those permissions. They started griping the day after we moved about 3 other things that were completely unfounded and untrue, and the things they are suing for are not even the same things they griped about for 3 weeks. They were constantly calling our new home several times a day, emailing me and harrassing the crap out of me. I've found out that these people make a living (not exagerating) at filing lawsuits. They want a settlement or they will file suit and I have to respond soon. I'm not sure what advice to ask here, but we are good people who never do anything wrong to anyone, always pay our bills (on time), do our best by others, obey the law and then we get slapped in the face with this. People just should not be able to sue without good reason just because they feel like it. Can I sue them for wasting my time and causing undue stress? I could file a lawsuit a day if that were the case. Anyway, if anyone reads this, thanks. If you have any advice, I'm open to it. |

They want a settlement or they will file suit and I have to respond soon. **Great! Let them outline in their suit what they want, you bring your proof to court. People just should not be able to sue without good reason just because they feel like it. **Unhappy people resort to all kinds of strange measures. Can I sue them for wasting my time and causing undue stress? **You can ask for damages and court costs. I doubt it'll get that far. They're just trying to rattle your chain. At the closing table when you received the keys should have been the end of their ownership. I could file a lawsuit a day if that were the case. **Then you'd be just like them, which isn't what you want, right? |

Back again!Well...after 2 months of my attorney speaking to their attorney, the buyers have once again threatened with a letter (reduced by $1K than originally asked for) to sue. They attached these absolutely ridiculous estimates for replacement curtain rods ($105 each for 9 of them that I paid $30 each for 5 windows) and painting of $1100. The invoice for painting doesn't even have a company name at the top of it, nor a phone number, address or anything. Looks like something someone typed up in Word, and it is dated for almost 3 months ago, but yet this is first time we are seeing it. My attorney is a very good one and was 'helping' me out by sending this guy a letter back in September that we were not going to pay because we had permission to take the rods and some of the other things they were griping about (which they have stopped griping about the other things). He is my company's attorney and he figured they would go away, so he wasn't even charging me to do all of this. However, during our last conversation in early October, he did tell me that it would be best if we settled because it would cost me a lot more in attorney fees to go to court and it is just not worth it, especially since I'm out of state now. Of course I voiced that this is a ridiculous law suit, that I had permission to take them and it's not the point...it is the principal of the matter and this guy makes a living off law suites and I'll be darned if I'm going to be one of his victims. Well his comment was that I am the kind of person attorneys LOVE because they would make a lot of money off me! ![]() And that sometimes you just got to do things you don't want. So, here I am with this decision that I'm not sure what to do. Any advice would be greatly appreciated. Also, are lawsuits public records? If so, where could I search for lawsuits involving a certain person? Thanks! |

| If you agreed to include these in the first place, why not drag the "stuff" back over to the house they bought and be done with it? Have them sign a reciept showing they took delivery.

| Thanks for the replies...Answer to the question about 'dragging' them back...not as easy as it sounds, I'm now 1000 miles away from there. Regarding the next comment...it wasn't a verbal permission. I have the emails from the buyers allowing me to take them. I even offered to replace them, but they declined because they did not know what they even wanted to put on the windows. |

| So ship back whatever can be shipped. Have a Mailboxes type place pack it and document the contents, and send it trackable. Window treatments and such are just NOT worth fighting over! Hey, I buy Ebay all the time. All kinds of stuff can be shipped cross country.
