buying a home

What is the name of your state? Florida I am currently married but have not lived with my spouse for 6yrs, we are separated but not legally, purchased a house in 2004 and now someone has informed me that when I start divorce preceedings that my spouse can claim half the house since I did not ask her permission first? I consulted an attorney in my area and was explained that if I did not use funds to purchase the house that was from the marriage that it would be ok, now I am afraid that I might have to pay out some money to this woman who has ruined my life, I have moved on and now living with my future wife. So please let me know if this will come up in a divorce preceeding. Thanks.

You're kidding right? You are married, you purchased a home and you think WHEN you file for divorce your WIFE won't want her legal rights to all MARITAL assets?

Guess what? If you die tomorrow, who do you think will own a minimum of 1/2 of the home?

Curious... why would you purchase a home (presumably joint owner) 2 years ago... when you haven't lived together for 6 years??

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

buying a home

it took us that long to get on our feet after leaving our spouses and getting the money to buy since the market here in florida is or was extremely high and the buyer was at a disadvantage. so there that is why we bought two yrs ago.

Ok just so I have this straight. You were both cheating on your spouses with each other and decided that you would both leave your spouses and move to Florida and then you bought a home and you think your wife is just going to sit back and let you keep it?

Is your concubine on the deed with you?

If so is she divorced yet?

If you had the money to purchase a home you should have paid for a divorce first.

If your concubine is still married also and she is on the deed to this new house then her husband could possibly also be entitled to his share.

You need a good lawyer.

OP deserves to loose everything since he didn't get the divorce. What's the deal here? Waiting to see if the affair worked out?

So, Poster, did you buy this house with ONLY premarital, non comingled assets, and pay cash for it, owning it free and clear, and not using any wages to make payments or improvements?
