Buying a home, but Tenant will not vacate


What is the name of your state?What is the name of your state? Massachusetts

Thanks for taking the time to read. My husband and I have waited a very long time to buy a home and we have obtained a government loan (which is not an easy feat). We have found a home and signed a PNS. The owner lives out of state (AZ) and has been renting the property out.
The person who is renting the home has always acted very peculiar whenever we have been in the home( showing, inspection, etc) and we have come to find out that she is an addict. Our real estate agent is also a social worker, she was mandated to tell the state about the case, and they removed the children because of the mothers mental state, they are now with thier father. Now she is refusing to leave the home that we plan to buy. the owner served her papers to vacate, but she has shown no sign of leaving.
I am not sure what our rights are, we cannot wait for a full eviction process because we too have children that would like the school year off in the new house, and we may not have the money to buy the home 9if the money runs out for the year for the governmant loan) What can we do to help remove this woman before our planned closing date at the end of July?

**A: make her an offer she can't refuse. Cash $$$$$ for moving out. Then she can buy more drugs.

If she does not want to move willingly this is probably the best encouragement. Of course you can phrase it so it does not come off as a bribe - "help with your expenses/inconvenience of moving" have the seller participate in paying if willing.

If I was in this situation I would probably close the deal and then worry about evicting her since it was so hard to secure your loan. This of course does not prevent the seller from pursuing the eviction process now although I don't know how the process would be affected if you took ownership midstream. If you can reach an agreement with her within the next week or so, great, if not contact an eviction service for some info on costs and length of process and get back with the seller to negotiate a solution.
