Question

buying house with condition


What is the name of your state? FL

I have a contract to buy a house (House A) to close on Oct. 10th or sooner, with the condition that my current house (House B) that I am selling closes before Oct. 10th. There is also a condition on my loan commitment that I must sell my house prior to getting the loan.

The buyer of my house (B) wanted to move in early and asked if we could close early on Sept. 10th. I agreed, and made arrangements to close on my new home (A) on Sept. 10. We did not sign a contract, but I did verbally agree to close on Sept. 10th. When Sept. 10th came, the buyer of my house (B), could not close due to loan problems. There is still loan problems and they cannot close yet. Because my house (B) didn't close, I could not close on my new home (A). The seller of the house I am buying (A), says that I am out-of-contract because we changed the closed date to Sept. 10th.

Is my deposit in jeapordy? I don't think the seller of house (A) is not going to agree to release my deposit, even though I have the conditions. Should I seek a lawyer?
