Buying a judicial foreclosed home

What is the name of your state? WA

We are in the process of buying a house that we knew up-front was a foreclosed home. House was put on the marked in April, our bid was accepted with a closing date of April 30th. The closing didn't take place as planned and on May 2nd we received a call from our lender telling us the house was not available yet, as it was a judicial foreclosure and the title hadn't been released by the sheriffs office yet (which we hadn't been aware of).

So my question is: was it legal for the house to have been put on the market and 'sold' when the bank selling it didn't have clear title to it? And are we within our rights to ask for compensation for the delay?

Thanks in advance for your help!

Still hoping someone knows if this was just 'one of those things' that happens when buying a foreclosed home ... or if we have a reason to be upset! Thanks!!
