We put in an offer on a house 3 days after it listed, it was already in escrow. We put in a back up and it was accepted. Buyer's agent was also Seller's agent. Our agent (from same R.E. Co.) told us, Buyer #1 had already dropped out of three escrows so may drop out of this one too. Next thing we know, Buyer #1 offers us his position on contract (he would back out) if we pay him $100K and his agent $50K.
They knew we REALLY wanted that house. They had their pigeon. On contract, Buyer #1 wrote his name "or assignee". We think it's obvious what the plan was from the start. However, this is all legal it seems. We want to know the circumstances of the last 3 escrows they did not complete but of course that info is confidential. Is there a Calif. Real Estate Commission or some agency we can contact about this? We would do just about anything to get out of paying that agent the $50K she does not deserve. She got the listing commission and still has her buyer and refused to negotiate or ask her client to negotiate at all.
We're paying the money because it is out dream house but it sure makes us furious the way it came down. Feels extremely unethical at best.

Oh jeez, if you were willing to pay $150K more for the property then don't complain here. You could have easily told them, thanks, but no thanks.
