Question

canceling listing agreement


What is the name of your state? california
the owners of the home across the street found out we were going to sell our home from other neighbors before we listed it but were out of town. we had listed it by the time they returned. they now want to buy it. can we cancel our listing agreement (3 more months) and sell it to them without having to pay a commission? they do not have a real estate agent.

**A: No because you most likely have an Exclusive-Right-To-Sell listing agreement. Please confirm this after you read the terms and conditions in that contract.

thank you very much for your swift reply. yes we do have an exclusive right-to-sell listing. so even if the broker agrees in writing to let us withdraw the listing, we owe her a commission even though our neighbors were not shown the house by her or another realtor? if we still owe her a commission, can we try to negotiate the 6% amount down? especially if our neighbors are willing to use her as their agent also?

**A: it does matter. Anyway you twist it she still gets the full 6%
if she does nothing, represents only you, represents both parties (under a dual agency) or represents only the Buyer.
