Question

Can't get off the Loan

A few years back an ex-roomate and I bought a house together. Once I got married I moved out and thought nothing of it. Now that I want to get my own house (by myself) my ex-roomate will not refinance or in any other way help me get off our loan. As you would imagine that house we have still counts against my credit and is therefore really holding me back from any major purchase. We live in Florida and from I have been able to read the quit-claim deed would not release me from the legal obligation to the house. Is there anything I can do to get my name off the loan? Ie, sell my half, bring legal action against him???

Exclamation

Thanks for the reply. Obviously the next thing for me to do is get a lawyer. Do you know off hand, what if anything I would have to prove or are there any conditions that must be met for the judge to grant one of these? My ex-roomate has been fighting me the whole time not to refinance or in any other way help me get my name off the loan, I just don't want him to be able to get out of this too.

You must prove owership interest and contributions ie. paying of mortgage, real property taxes, repair and maintenance, who had possession and use of the property etc.
