Cell phone tower problem


What is the name of your state? Texas

I am trying to sell my house. The problem is that 8 mo. ago a huge cell phone tower was put up behing my house(land owned by The Knights of Columbus) Almost all of the prospective buyers love the house but said the cell tower just kills the deal for them. Do I have any legal options regarding this tower? House has been on market almost 5 mo. and is priced below what it appraised for. Any advice would be appreciated....thanks!

At this point, probably not. Where were you when they were putting up the tower. There is almost always some sort of hearing in the siting of these things.

In Texas, the siting issues are left up to the local governments. Typically they allow them by right in industrial districts and by special exception in other districts with special prohibitions on residential, near residential, and environmentally sensitive areas. Further most have rules specifying preferred siting and colocation to minimize the impact. But I can almost assure you that there was a siting hearing. The fact you weren't paying attention doesn't mean it didn't happen.

My neighbors and I were not aware of any hearing, for awhile we thought The Knights of Columbus were relocating their main building because the constuction took awhile...they cleared many large trees and were putting in cement for the foundation. There is actually a small building they built on the concrete, but then we saw the tower being put up and by that time it was already over a month into constuction.
Is there anyone out there that has heard of this type of problem (cell tower lowering propery value?) And was there any kind of solution?
I am coming to the conclusion that we didn't do enough early enough....
Just hoping someone will like the house and area enough to forget about the tower and put in an offer!!
