I live in Mississippi and have a court order that states my ex-husband owes back child support and orders him to pay it within 10 days of March 6. 2001. He has not paid (Ican get the documentation from DHS but I can not get them to file the lien). He is selling a house. Can I put a lien against the property myself, if so what is required? Thanks

Get an attorney right away to file a lien on the property and if it is in escrow file a complaint stopping the sale.

Thanks for your reply. I have an attorney however I can not get her to file the lien and I can't afford to hire another at this time. I have been to the Federal Office of Child Support Enforcement website and gotten the form to file the Notice of Lien. I have filled out the form as instructed by the OCSE and included the legal description of the property. Can I file the lien myself or does it have to be done by an attorney? Not only does my ex-husband owe child support but medical expenses as well. Can I add the medical expenses to the amount on the lien?

In reference to the above reply, I just read that I must have a judgment to file a lien, I have an order signed by a judge stating my ex owes the past child support, but I don't have anything that is titled Judgment. I have the original order where my ex was ordered to pay 1/2 of medical not covered by insurance, but I do not have an order that states he has not payed the medical that he owes.I do have all the medical receipts, insurance statements, and letters I've written my ex concerning the medical he owes.

That is why you need an attorney to help you. There are complications, as you well know and things must be done the correct way.
